  • When the CG, Civil Defence Bended the Knee

When the CG, Civil Defence Bended the Knee

The Commandant General of the Nigeria Security and Civil Defence Corps (NSCDC),Ahmed Abubakar Audi, was recently in the news when he publicly apologized to the Inspector General of Police (IGP) over a petition filed by one of his subordinates ACC Attah John Onoja, Commander of the Mining Marshal, against the Inspector General of the Nigerian Police Force, Kayode Egbetokun.

According to media reports, the petition submitted to the Senate Committee on Ethics, Privileges, and Public Petitions, accused the Nigerian police of alleged attack and shooting of mining marshals, obstruction of efforts to prosecute illegal miners in Nasarawa state through a Federal High Court order which NSCDC claimed was criminally acquired.

The NSCDC management, in a statement released by its National Public Relations Officer, Babawale Afolabi, however later clarified that the petition was filed by Onoja without authorization and does not reflect the official stance of the Corps. The Commandant General promptly distanced himself from the petition and disowned ACC Onoja the Commander of the Mining Marshal.

In the words of Audi Abubakar: “I have spoken to the IGP on the matter and sincerely apologized for the embarrassment that the petition might have caused,”

This public apology by the Commandant General of the NSCDC is a public admission of the rot in the NSCDC and the administrative incompetence of Audi to manage a complex paramilitary establishment like NSCDC.

To begin with, that a subordinate officer under your watch could have generated a petition against the person of the Inspector General of Police and the entire force without the knowledge of the head raises questions about the line of reporting within the hierarchy of the Corps. In every government establishment, the standard practice is that every correspondence emanates from the office of the Chief Executive and similarly every incoming correspondence is addressed to the office of the CEO, who then treat and minutes to the appropriate departmental heads as the case may be.

That an ACC who in the chain of command with about four very senior ranking officers ahead of him can unilaterally generate a petition against an agency and its head then forward same to an arm of government like the National Assembly do not only speaks of gross insubordination but also an indictment of the entire administrative structure of the Corps.

Secondly, while embarking on the shameful mission of public apology to the Inspector General of police as if NSCDC were to be a department of the Police Force, it was without an initial firm disciplinary measures against the erring officer. Audi, was in a hurry to betray throw the erring officer and the entire Corp under the bus to vindicate himself, this indicates inherent weakness and inability of the CG to take disciplinary measure against his officers and men, this is precipitously dangerous.

In a military or paramilitary establishment, a clear hierarchical structure ensures discipline and orders are passed down efficiently, responsibly and followed through.

This helps maintain order and ensures tasks are completed effectively and helps promote a culture of accountability and professionalism, reinforcing the importance of adherence to established protocols, procedures and discipline. Evidently, this is lacking in the NSCDC.

The extant case with the NSCDC indicates operational ineffectiveness, indiscipline, lack of team cohesion a break down in the chain of command which is clearly reflected in the activities of rogue commanders and teams within the NSCDC

According to sources within the Interior Ministry, there is palpable disquiet within the ranks and file of the Corps as a result of the breakdown in the chain of command and blatant abandonments of critical administrative organs of the Corps, the ACGs and Commandants currently serving at the National Headquarters of NSCDC have no working tools, office space and official vehicles are strictly for the associates of the CG many of them not members of the Corps. However they are alleged to wield undue influence within the service as a result of their relationship with the CG.

Other sources who spoke to our correspondent also pointed at the indiscriminately allocation of portfolios and official vehicles to Junior officers while senior officers are relegated to the background without commensurate assignment befitting their offices and ranks.
“Audi have continued to run the Corps like his personal chiefdom, you have to be his yes man ready to do his bidding no matter how ugly to be assigned an office and working tools, most of the senior officers in the Corps don’t have offices not to talk of assigned duties, they just go there to roam around until closing hours and then go home” said the source.

Speaking further, he said the chain of command is completely broken, which is responsible for the indiscipline within the Corps. “The blame is on the head, there is a popular saying that, when a fish wants to rot it, starts from head. Do you know thay most of the official and security documents are taken to business centers for typing and printing? This is because there are no papers, computers and photocopy machines to process it within the office. The few offices that have these tools, don’t have power supply. Power supply only comes up for Audi any day he decides to be in office. On several cases and occasions personnel have to contribute money to attend to official document such as annual leave, pass, permission from duty and the likes This includes basic training activities within the Corps”. The source alleged.

Speaking further, the source accused Audi of not being attuned to his job specification saying, “Audi is only interested in his personal survival and getting a second tenure in office, this is the reason you see him gallivanting and hobnobbing with politicians, he is not interested in building the NSCDC into a force that is ready to face the security challenges bedeviling the country”.

From all indications, the recent fracas between the Nigerian Police force and the NSCDC is not only a revelation on the broken down chain of command within the Corps but also a wakeup call on the Federal Government to institute a probe into the activities of the NSCDC under Audi to unravel its internal contradictions, ascertain its problem with a view to reorganizing it and properly positioned to respond to the growing challenge of insecurity in the country.

  • Changsha Declaration: Reaffirming South- South Solidarity And Commitment

Changsha Declaration: Reaffirming South- South Solidarity And Commitment

    By Dr. Austin Maho

The just concluded summit between China and African leaders and subsequent Changsha Declaration reaffirms commitments to solidarity within the Global South, promoting cooperation on development initiatives, resistance to unilateralism, and enhancing economic partnerships between China and African countries.

The meeting was hosted in Changsha, Hunan Province, under the broader Forum on China-Africa Cooperation (FOCAC) framework which would be celebrating its twenty-fifth anniversary this year.

In a world plagued by unilateralism and growing nationalism and abandonment of a ruled based global order hinged on global institutions like the United Nations and other global bodies the Changsha summit is an affirmation by the global south of multilateralism and a rule based global order.

recall that in September 2024 the 24th FOCAC summit was held in Beijing China were member countries adopted the Beijing Declaration, establishing an “all-weather China Africa community with a shared future for the new era” and upgrading bilateral relations with all 53 African states to a strategic level. For Nigeria the relationship was upgraded to strategic comprehensive. They also endorsed the Beijing Action Plan (2025–2027), outlining ten partnership initiatives across sectors like infrastructure, trade, health, digital tech, green energy, security, and governance. The Changsha Summit draws from the Beijing summit as a follow up on action and implementation to reviewed progress and produced a report detailing specific outcomes across the ten partnership areas.

The 2024 FOCAC summit was pivotal, it was an epochal moment in deepening China Africa strategic alignment, renewed financial commitment with a shift toward quality projects and capacity building, infrastructural development and robust affirmation of a shared vision of development and south south cooperation. FOCAC 2024 is the fore runner of the Changsha Summit, reinforcing China-Africa unity within the Global South, with coordination on geopolitical and opposition to unilateralism.

As a review summit the Changsha declaration is key to sstrengthening Solidarity Within the Global South. Drawing from FOCAC 2024 the Changsha declaration further expresses a commitment to establish a stronger collective identity among developing nations, recognizing the rise of the Global South as pivotal for future development. China and African nations emphasize their roles as key participants in promoting multilateralism and resisting unilateral pressures from dominant powers, particularly in trade and economic policies

It outlines plans for enhanced economic partnerships, including expanding zero-tariff treatments on goods traded with African countries, which will significantly boost trade dynamics. The focus on sectors like green industry, e-commerce, and technology indicates a shift towards sustainable and tech-driven economic growth. Enhanced market access for African products aims to increase trade volume and foster mutual benefits

The declaration condemns unilateral actions and economic bullying, calling for efforts to resolve trade disputes through dialogue and consultation rather than coercive measures. This positions China and African states as advocates for a more equitable global trading system

The declaration emphasizes China’s readiness to increase development assistance to African nations, underscoring the need for collaborative efforts to address socio-economic challenges, reduce poverty, and improve livelihoods. This support aims to empower African nations in their development goals, particularly those outlined in the African Union’s Agenda 2063

By reinforcing the UN-centric international order, the declaration seeks to increase collective bargaining power for Global South countries in global governance structures. This advocacy for true multilateralism contrasts sharply with the prevailing trends of unilateral decisions by major powers

The China-Africa Changsha Declaration is pivotal for shaping the future of cooperation in the Global South, aiming to build a community of shared destiny that emphasizes mutual respect, support, and sustainable development. It sets a precedent for collective action among developing nations and underscores the importance of economic partnerships that respect sovereignty and promote growth equitably. By standing together, the nations involved hope to navigate global challenges more effectively and secure a more just international order. Essentially, this declaration could be a transformative step in reinforcing the unity and strategic partnerships among the countries of the Global South.

Happily Nigerian foreign minister Ambassador Yusuf Tuggar attended the high level meeting together with the Director-General of the office of the Nigeria-China Strategic Partnership Joseph Tegbe and both of them made useful contributions. The Nigerian delegation were received by the Chinese Foreign Minister Wang Yi and Mao Weiming, Governor of Hunan Province. This is clearly in line with the comprehensive strategic partnership between Nigeria and China in furtherance of deepening China-Nigeria cooperation.

Sources in the Nigerian delegation also revealed that several cooperation agreements were reached with many Chinese companies desirous of setting up presence in Nigeria and bringing in the much needed foreign direct investment that would give the much needed boost to the Nigeria economy.

In line with the renewed hope agenda of the Bola Ahmed Tinubu administration, perhaps no better time than now for Nigeria to incorporate the FOCAC 2024 ten action plan into its economic programme. The action plan not only speaks to the developmental challenges of the continent but specifically to Nigeria in the march towards economic rejuvenation and meeting the aspiration of millions of Nigerians in achieving, poverty reduction and accelerating economic growth.

Nigeria as the largest black nation in the world must be at the forefront in solidifying the momentum from the Beijing FOCAC Summit, and transitioning broad strategic commitments into actionable, multi-sector initiatives for the benefit China Africa unity.

A New Chapter of China-Africa Friendship: China Initiates Further Preferential Measures for Africa

By Mr. Zhang Yi, Chargé d’Affaires of the Chinese Embassy in Nigeria

On June 11, 2025, the Ministerial Meeting of Coordinators on the Implementation of the Outcomes of the Forum on China-Africa Cooperation was held in Changsha, Hunan Province of China. Chinese President Xi Jinping sent a congratulatory letter to the meeting. H.E. Wang Yi, member of the Political Bureau of the Communist Party of China Central Committee and Chinese Foreign Minister attended the opening ceremony and delivered President Xi’s congratulatory letter. More than 100 ministerial-level officials from African countries, representatives from the African Union Commission, and ambassadors from African countries to China attended the meeting.

The meeting reviewed the early harvests achieved in implementing the outcomes of the Forum on China-Africa Cooperation (FOCAC) Beijing Summit held last year, focusing on strengthening China-Africa coordination to implement the Six Proposals for Joint Modernization and the ‘Ten Partnership Actions’ proposed by President Xi Jinping.

The meeting issued the China-Africa Changsha Declaration on Upholding Solidarity and Cooperation of the Global South, sending a resounding voice of the Global South countries to enhance solidarity and collaboration, uphold international fairness and justice, and safeguard their collective interests.

In the congratulatory letter, President Xi Jinping articulated the significance of China-Africa solidarity and cooperation, and announced a series of important measures by China to further expand open cooperation with Africa as follows.
First, China stands ready to expand the zero-tariff treatment for 100% tariff lines to all 53 African countries with diplomatic relations, through the entry into agreements on economic partnership for shared development.

Second, building upon the zero-tariff treatment for 100% tariff lines, China will facilitate greater access to exports from Africa’s Least Developed Countries (LDCs) to China.

Third, China is ready to work with the African side to further implement the ‘Ten Partnership Actions’, strengthen cooperation in key areas such as green industries, e-commerce and payment, science and technology, and artificial intelligence, deepen cooperation in such fields as security, finance, and the rule of law, and jointly promote high-quality development of China-Africa cooperation.

These new measures address the most urgent needs and pressing concerns of our African friends, epitomizing the great spirit of China-Africa friendship and cooperation, demonstrating China’s principle of sincerity, real results, amity and good faith toward Africa, as well as its commitment to the greater good and shared interests.

These measures will undoubtedly accelerate the delivery of more and better benefits from last year’s Summit outcomes to Chinese and African peoples, significantly boost Africa’s strategic autonomy and development, and open a new chapter of the high-quality development of China-Africa cooperation.

The world today is far from peace, as it faces a backlash of anti-globalization, unilateralism, protectionism, and hegemony, which brought serious challenges to the economic and social development of developing countries, including those in Africa.

Only when China and Africa join hands to advance modernization, can we foster unity and cooperation among the global South and open up brighter prospects for the cause of world peace and development. As Chinese Foreign Minister Wang Yi pointed out in his speech, when China and Africa stand shoulder to shoulder, the development and revitalization of the Global South gains greater promise, and international fairness and justice finds stronger safeguards.

The more complex and turbulent the international landscape becomes, the more imperative it is for China and Africa to strengthen unity and self-reliance, stand firmly on the right side of history, actively steer the course of the times, and address the uncertainty in the world with the stability and resilience of China-Africa relations.

Having weathered storms and challenges, China-Africa friendship grows ever stronger with time. Against the backdrop where certain countries have instigated global trade wars, erected widespread ‘small-yard, high-fence’ barriers, and cut off aid and supplies to Africa, China remains steadfast in advancing high-level opening-up. We will continue to promote high-quality development of the Belt and Road Initiative, deepen China-Africa cooperation through openness, offer new opportunities to the world with the achievements of Chinese modernization, and inject new impetus into African and other Global South partners through China’s vast market.

H.E. Yusuf Tuggar, Foreign Minister of Nigeria, and H.E. Joseph Tegbe, Director-General of the Nigeria-China Strategic Partnership, led the Nigerian delegation to attend the Ministerial Meeting of Coordinators for the Implementation of the Outcomes of the Forum on China-Africa Cooperation and the China-Africa Economic and Trade Expo. Nigeria is also the Guest of Honor at this year’s China-Africa Economic and Trade Expo.

The Nigerian delegation received a high-level reception from the Chinese side in Changsha. Chinese Foreign Minister Wang Yi and Mao Weiming, Governor of Hunan Province respectively met with the Nigerian delegation and reached important consensus with the Nigerian side on deepening China-Nigeria cooperation.

The Nigerian side also discussed cooperation with several Chinese enterprises. I believe that in the future, more Chinese enterprises will invest and start businesses in Nigeria, and work together with Nigerian friends to contribute to the economic and social development of Nigeria and realize ‘the Renewed Hope’ agenda .

China will always be the most trustworthy friend and partner of Nigeria and Africa. China stands ready to continue working hand in hand with Nigerian and other African friends to jointly advance the implementation of the ‘Ten Partnership Actions’ for China-Africa cooperation in pursuing modernization and the new measures adopted at the Coordinators’ Meeting.

We will remain committed to the principles of open cooperation and mutual benefit, jointly oppose unilateralism and protectionism, continuously elevate China-Nigeria and China-Africa partnerships to new heights.

  • Ex Minister, Essien denies joining APC but pledges support for Gov. Eno.

Ex Minister, Essien denies joining APC but pledges support for Gov. Eno.

    By Ogenyi Ogenyi,Uyo

A former Minister of Lands, Housingand Urban Development Chief Nduese Essien has debunked speculations that he has dumped the Peoples Democratic Party for the All Progressive Congress, following the defection of Gov Eno.

Essien who stated this in a press conference in Uyo on Tuesday said the rumors of his defection emanated from the event he attended where Eno formally defected to APC stressing that he attended in solidarity with the governor as elder statesman and indigene of Akwa ibom.

According to the former minister, ‘let me state without ambiguity: I have not defected from any party to another. My attendance at the event was not a declaration of political affiliation but a demonstration of support for the governor, who has shown a rare level of maturity and inclusiveness in governance”.

“Since my decision not to contest for any elective office at the age of 70 in 2014, I have chosen to function purely as an elder statesman—offering advice, promoting peace, and standing for what is just and equitable in our state and country.”

Essien who was also former Chairman, South-South Parliamentary Caucus of the National Assembly maintained that Eno’s defection remained his personal political decision, backed by his constitutional right and informed by what he must have considered the long-term interests of Akwa Ibom State.

“It is not my place to question his right to reposition himself politically. The most cogent reason for his defection is the lingering uncertainty over the future of the PDP in a self-inflicted debacle through years of impunity and lack of internal democracy in the party.

“Seeing the unending nature of the controversy, Governor has taken the right decision to secure his next election in a party platform that is relatively stable, for now,at the National level. Joining the APC naturally takes him to work with the Government at the centre with envisaged ancillary benefits. It is my wish that his hopes be fulfilled in this regards.

“Let me also highlight that even before his defection, Pastor Umo Eno had shown an admirable level of maturity in navigating party lines. He supported the Senate President, Senator Godswill Akpabio, and endorsed President Bola Ahmed Tinubu of the APC for a second term, despite being a PDP governor. These actions, while controversial to some, were calculated to ensure peace, stability, and strategic alignment for the benefit of Akwa Ibom State.

He however criticized Senate President Godswill Akpabio for not reciprocating the Governor’s gesture in matters of appointments

“Sadly, such magnanimity has not been reciprocated by the Senate President or his political machinery. Appointments, empowerment programmes, and political opportunities have remained exclusive to APC loyalists, leaving out PDP members and even those who have chosen neutrality for the sake of peace. This lack of inclusion has continued despite the governor’s overt gestures of goodwill and cooperation.

“In contrast, Governor Umo Eno has empowered citizens across party lines, ensured that appointments reflect the state’s diversity, and resisted the temptation to weaponise government against perceived opponents. That is commendable.” Easien said.

The former Minister advised the governor not to exclude or sideline those who refused to defect with him stressing that such action could erode that legacy of fairness and compromise.

He commended the governor for his support for Senator Akpabio noting that the position as Senate President and no 3 man, is most commendable. “It is not often that this position comes to any state for a long while. It has taken 40 years for it to come back to the South South”.

“Teaming up with the Senate President in his party will generate respect and strengthen his position in the APC and in Government.’ he emphasized.

He maintained that as an elder statesman, his priority remains the unity, peace, and development of Akwa Ibom State., insisting that he will continue to lend voice and wisdom to ensure that political differences do not tear his people apart but rather coexist with dignity, maturity, and mutual respect.

NSCDC Under Fire Over Activities of Mining Marshal

Police and NSCDC officials in deadly confrontation over control of mine in Nasarawa
    • NSCDC CG disown Mining Marshal over petition to Nigerian Senate

    By Gabriel Udeh

The recent spate between the Nigerian Police and the Mining Marshal an outfit under the office of the Nigerian Security and Civil Defence Corps ( NSCDC) over control of a mining site in Nasarawa state has once again brought to the front burner the inter agency rivalry between the Nigerian police force and the NSCDC while raising question over the legality and corruption allegation over the activities of the Mining Marshal.

    A Brewing Crisis
Evidently, mutual suspicion and distrust characterises the relationship between the Nigerian Security and Civil Defence Corps (NSCDC) and the Nigerian Police. The recent incident in Rafin Gabas, Kokona Local Government Area of Nasarawa State, which almost degenerated into an all out shoot-out between the police and the Corp, only serves to emphasise this fact.
According to information available to daybreak Nigeria Police operatives from the Force Headquarters in execution of a court order allegedly stormed the mining site to secure it and conduct investigation over series of petitions only to discover that the site has been taken over by the NSCDC, Mining Marshals.
The police team, reportedly led by one Chief Superintendent Abdulmajeed Abisoye Oyewumi, acting on a Federal High Court order had to retreat to avoid an all out bloody confrontation. However, the NSCDC’s Mining Marshals reportedly challenging the legitimacy of the court order, alleging that it was obtained through suppression of facts.

    NSCDC, Mining Marshal Petitions Police
The Mining Marshal after the confrontation with the police quickly petitioned the Senate Committee on Ethics, Privileges, and Public Petitions, accusing the Nigeria Police of obstructing the prosecution of illegal miners arrested in Rafin Gabas, Nasarawa State.
The petition, was copied to key government officials—including the Ministers of Interior, Solid Minerals, and Police Affairs, as well as the Chairman of the Police Service Commission. The petition was dated June 2, 2025, with reference No: NSCDC/NHQ/CG/MM/Vol.6/001/2025. Curiously the petition was signed by the Commander of the Mining Marshals, Attah John Onoja, raising questions on where he drew the authority to petition the Inspector General of Police without clearance from his boss, the Comptroller General (CG) of the NSCDC.

The petition alleges that officers of the Force Intelligence Department (FID), led by CSP Abdulmajeed Abisoye Oyewumi, invaded the mining site, assaulted and arrested NSCDC personnel, and interfered with legal proceedings. The arrested miners, who including Chinese nationals, reportedly confessed to operating without licenses since 2021 and were said to be facing trial in Abuja.
The NSCDC further claims that the Police obtained a court order based on false information, using it to disrupt its operations. The petition also alleges that CSP Abdulmajeed attempted to coerce detained NSCDC officers into implicating their commander and threatened military bombardment of the secured site.

Police Response to Storming the Minning Site
Sources within the Nigerian police revealed to this newspaper that the police apart from acting on a court order has been receiving series of petitions against the activities of the Mining Marshal bordering on high-handedness, illegal detention, extortion of detainees, false accusation and illegally sealing off mining sites even when operators of the mines are in procession of mining licences and consent documents from the host communities. There have also been accusation against the Minning Marshal of displacing legal mine operators and owners only to turn around to give protection to other parties to resume mining activities with the connivance of high government officials especially in the ministry of solid minerals.
Reacting to the development, Force Public Relations Officer ACP Olumuyiwa Adejobi explained that the police were not at the site to dispute its control but were acting on a legitimate investigative mission. “I can authoritatively confirm that our operatives were assigned to investigate serious cases of murder and criminal activity following multiple petitions from residents in the area,” Adejobi said. “The investigation is ongoing, and some security operatives may also be required to answer questions. This operation is not about guarding mining sites.” He reportedly said.

NSCDC Commandant Dissociate Corp from Petition, Disowns Onoja
However, in a swift and dramatic twist to the petition by the commander of the Minning Marshal the Commandant General of the Nigeria Security and Civil Defence Corps (NSCDC), Dr. Ahmed Abubakar Audi, ordered the immediate withdrawal of Mining Marshal’s Petition to Senate Against the Police.

In a statement issued on Sunday June 8, 2025 and signed by CSC Babawale Afolabi, the National Public Relations Officer of the Corps, the Commandant General categorically dissociated the Corps’ Management from the petition. He stated that John Attah Onoja acted without clearance and was not mandated to engage the Senate on such a sensitive inter-agency matter. According to him the petition was, “unauthorized and outside the operational purview of the officer involved”.

Dr Audi emphasized the importance of a harmonious relationship between the NSCDC and the Nigeria Police Force, disclosing that the Inspector General of Police (IGP) was not aware of the incident prior to the filing of the petition. He further noted that the IGP has consistently demonstrated goodwill and cooperation towards the NSCDC in advancing national security and the objectives of President Bola Ahmed Tinubu’s Renewed Hope Agenda. “I have spoken to the IGP on the matter and sincerely apologise for the embarrassment that the petition might have caused,” the NSCDC CG said.
“I have also directed that the petition be withdrawn immediately with a view to resolving it administratively without any rancour.” The CG also vowed to take disciplinary measures against Onoja for what obviously amounts to acts of insubordination.

Onoja In The Eye Of The Storm
Observers have however pointed out that the petition to the Senate Committee on Ethics and Privileges was a face saving move by Onoja to divert attention from scrutiny and serious allegations of corruption pending before him. Apart from the serious allegation of corruption against Onoja , there is also an ongoing investigation of misconduct and interference against him and his men over a mining site in Rafin Gabbas in Nasarawa State. The allegation against the Mining Marshal includes, culpable homicide, trafficking of underage children for forced labour, and obstruction of justice.

In suit number FHC/ABJ/CS/901/2025, filed before Justice Emeka Nwite at the Federal High Court, Abuja, the Nigeria Police accused John Onoja, Commander of the NSCDC’s Mining Marshal, of facilitating illegal mining through two companies: Capital Apex Synergy Global Services Ltd and Nizhong Mining Company Ltd.
An affidavit submitted by Gregory Woje on behalf of the Inspector-General of Police detailed that the Force received four petitions—two from traditional rulers and two from legal practitioners—alleging illegal mining activities and resultant deaths. These activities were alleged to have been facilitated by Onoja and his recent grandstanding are attempts to divert attention from investigation.

The affidavits in support of the legal action claims that trafficked underage children from several northern states were exploited for mining work under hazardous conditions and reportedly fed hard drugs to keep them working.

According to the affidavit, many of these children have died and were buried in secret, while community members attempting to report the abuses faced threats, injuries, or even death, causing widespread fear that has affected farming and other daily activities. The Mining Marshal allegedly in cohort with the owners of the mines turned a blind eye and gave protection to owners of the mines covering up their nefarious activities.
However , the affidavit noted that NSCDC officials arrested in the cause of investigation were later released while investigation were yet to be concluded, further complicating inter-agency relations.
In response to the submissions, Justice Nwite issued a ruling on May 20, 2025, granting an order restraining John Onoja and his team from interfering with or conducting operations at the mining site pending the outcome of ongoing investigations.

Onoja acting on the orders from top government officials who have been fingered as proxy owners of the mines reportedly violated the restraining order by conducting operations and deploying his men on the mining site and allowed mining activities to continue in defiance of court orders, a situation that led to the confrontation between the mining marshal and the Nigerian police force.

    Dele Alake and Onoja Alliance

Sources within the NSCDC have alleged that Dele Alake the minister of solid minerals and the head of the mining Marshall John Onoja have an unbreakable bond hence he was hand picked by the minister in the first place to head the unit after its creation about a year ago. The allegation is that Onoja is an in-law to the minister hence he was given the job ab-initio. Speaking on the relationship a Source within the NSCDC opined that this relationship may not be unconnected to why Onoja behaves as if he is untouchable: ” it is no secret that John Onoja is an in-law to the minister, that is why he is operating like a rogue officer and only reports to the minister of solid minerals, who has equally ensured his rapid promotion within the service. He has been promoted twice within the last three years, while many of his colleagues have remained in the same rank for upward of about five years and more. He doesn’t report to his immediate boss who is suppose to be the head of the Directorate of Intelligence and Investigation. However the conundrum was created by the CG himself who behaves more like a politician than a professional officer. The CG Special Intelligence Unit(SiS) derives it’s power from the Directorate of Intelligence and Investigations (DII) headed by a Deputy Commandant General, does the Commander of CGSIS who is far junior to a DCG report to the DCG? The answer is No. The Corp itself needs a lot of house cleaning. It is no surprise therefore that the mining marshal is like a private army of a politician and a power onto itself. The situation has irked the hierarchy of the Corp who have watched with consternation the unprofessional conduct of a subordinate who defy official line of reporting with impunity because he is being protected by a politician. His unilateral action of writing a petition against the IGP against all known procedural rules tells you how power drunk Onoja has become.”.

    Legality Of Minning Marshall
Some legal expert who spoke with our correspondent have weighed in on the legality or otherwise of the activities of the Mining Marshal describing it as an illegal contraption that is not backed by law. Speaking to our correspondent an Abuja based legal practitioner, John Okocha wonder were the mining marshal draws its powers, “What is the source of their power. Nigeria is not a banana republic, democracy is based on the rule of law not on the whim of individuals no matter the good intensions. The establishment act of the NSCDC is based the 2003 and 2007, Acts of the National Assembly, none of these gives allowances for the existence of any entity like the mining marshal so the question is where do they derive power from? Clearly its is an illegal creation not backed by any known law, hence the impunity we are witnessing. If there has been an enabling law there would be guidelines and operational procedures, not the whim of an individual, its a dangerous precedence that must be checked or else every minister can now set up an armed gang drawing men from any of the security services and give it a fancy name and allow it to operate with impunity”.

“Even if you want to accommodate it under critical and national infrastructure, why then does the mining marshal not report to the CNAI Directorate where the power to operate comes from? Why reporting directly to the minister? Nations are build by strong institution not strong individuals or institution created to satisfy individual ego”.

If the minister of solid minerals desires the creation of a mining marshal that would be institutionalised under the NSCDC the right thing to do is follow due process, push for an amendment of the NSCDC Act to accommodate the mining marshal. As currently constituted any smart lawyer who decides to go to court to challenge the legality of the mining marshal may win the case”

Also speaking in similar light a legal practitioner, Uyi Precious, opined that the creation of the Forest Guard by the federal government takes pre-eminence over the mining marshal. According to him, “One is a creation by a binding executive order by Mr president and the other a contraption hurriedly put together my a minister. Except he claims superiority over a presidential order the mining marshal cannot exist side by side with the forest guard. they seizes to exist by the consequential pronouncement of Mr president creating the forest guard. The forest guard cannot exist side by side with the mining marshal, it would be a duplication and a recipe for conflict, if they are already having conflict with the police imagine what would happen when the forest guard becomes fully operational. The Forest Guard would operate in forested areas of he country and we know this as the areas were illegal mining takes place”
