N523M judgement debt: Contractor confiscates Kaduna govt properties

Sequel to an order from the high court of justice of Kaduna state on the 17th of April, 2024, the Drainage Contractors Association (DCA) has confiscated property belonging to Kaduna State Roads Agency (KADRA), over non payment of debt.

In the suit no: KDH/KAD/628/20, the claimants seek an order for summary judgement against the agency of Kaduna state (KADRA) in the sum of N523, 043, 090.61, with 10 percent interest from the date of judgement until the judgement sum is fully liquidated.

Meanwhile, in his judgement, Honourable Justice M.M Ladan, ordered KADRA to pay the said amount, being the aggregate sum of what the defendant is owing the plaintiffs.

“The defendant shall pay interest at the rate of 10 per cent of the judgement sum from the time of judgement until the date when the judgement sum is fully liquidated,” justice Ladan averred.

The contractors, in the suit also prayed that the cost of filling the suit be paid by the agency.

Carrying out the confiscation enforcement on Thursday at the KADRA sites, the Chairman of the Drainage Contractors Association, Aminu Idris told journalists that some indigenous contractors totalling 112 were engaged to carry out some contract works for the state during the last administration, but adding that they were yet to be pay.

While speaking, the counsel to the plaintiffs, Barr. Nnamele Onyegbosi explained that the case has lasted for a period of four years.

“It is a case that was taken to full trial. The case was filed in 2020, and judgement was given in 2024. I know they will come to negotiate and we will accommodate them when they do so,” Barr. Onyegbosi explained.

Property confiscated at the main office of KADRA and its site include four Hilux buses and three heavy trucks, which were moved out under the supervision of security operatives and court baliffs.
