BREAKING: Justice Binta Nyako to Withdraw from Nnamdi Kanu’s Trial

At the Federal High Court in Abuja on Tuesday, Justice Binta Nyako announced her intention to recuse herself from the trial of Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB). The decision came after Kanu openly requested that she step down, accusing her of failing to comply with the Supreme Court’s orders.

Recusal, as defined by legal dictionaries, occurs when a judge agrees to step aside from a case due to a conflict of interest or other valid reasons. Kanu argued that he had lost confidence in the court, insisting that Justice Nyako should withdraw from his trial for refusing to follow the Supreme Court’s rulings.

Justice Nyako, in response, expressed her willingness to recuse herself and confirmed that she would send the case file back to the Chief Judge for reassignment. “I hereby recuse myself and remit the case file back to the Chief Judge,” she declared.

Kanu, who faces a seven-count charge related to terrorism, voiced his frustration in court, referring to the Supreme Court’s judgment that raised concerns about potential bias. He further criticized the court’s refusal to comply with the Supreme Court’s decision.

The prosecution counsel, Adegboyega Awomolo (SAN), attempted to persuade Justice Nyako to continue with the trial. However, she stood firm in her decision to step down from the case.

This development follows ongoing legal battles between Kanu and the Federal Government, with Kanu’s legal team arguing that he has been denied a fair trial.
