    BREAKING: Buhari may not appear before Reps for fear of embarrassment – Sources

    President Muhammadu Buhari may not appear before the House of Representatives on Thursday as earlier scheduled, sources say.

    It will be recalled that the House had on December 1 reached a resolution via a motion to invite the President to the national assembly.

    The invitation followed the killing of over 43 rice farmers in Zarbamari village, Borno State penultimate Saturday. The Presidency had last week agreed that the President will honor the invitation.

    On Monday, the main opposition People’s Democratic Party PDP’s caucus led by Hon. Kingsley Chinda from Rivers State in a statement asked Nigerians to prevail on their representatives to commence impeachment processes against the president, saying he had failed on his constitutional obligations to protect lives and property.

    But events took a dramatic twist Tuesday night with series of meetings of different camps of lawmakers and some governors of the ruling All Progressives Congress, APC at the national assembly.

    Sources told Vanguard that PDP caucus met somewhere at the second floor of the House of Representatives wing (New building) last night to strategize.

    Their agenda, it was learnt was to pose some questions and actions that may appear embarrassing to the president should their plan to kickstart an impeachment procedure fail.

    While they were meeting, Vanguard learnt that another meeting that involved Governors Aminu Masari of Katsina State and Hope Uzodinma of Imo State with Senate President, Ahmed Lawan, the Speaker of the House, Femi Gbajabiamila and some of the APC principal officers in the House held at Room 028 the same night.

    Sources who craved anonymity said that the Senate has completely pulled out of the meeting, saying it was a House affair even as they insisted on the sack of the Service Chiefs.

    It was learnt APC governors advised against the president’s coming for fear of being embarrassed.

    They expressed shock that many of the APC lawmakers were in cahoots with their PDP counterparts in the embarrassment plot. But on his part, Gbajabiamila pleaded for understanding, assuring that there was no cause to back down on the president’s appearance.

    The plea however fell on deaf ears. The meeting, it was learnt ended mid night. Vanguard’s attempt to reach the House spokesman, Ben Kalu for reactions on the matter failed as he neither answered his call nor replied the sms sent to his phone as at the time of filing this report.

    The Peoples Democratic Party, (PDP) has asked the Independent National Electoral Commission, INEC, to deregister the All Progressives Congress, APC, over what it described as total failure, humongous corruption as well as the plagues of economic recession, violence, killings and hardship the party brought to the people.

    Disclosing this in a statement signed by Kola Ologbondiyan, National Publicity Secretary, the party congratulated Nigerians, noting that their tormentor for five years has finally dissolved out of the political firmament.

    According to the statement, “With this exit, December 8, 2020 has gone into the history of our nation as liberation day, especially given the spontaneous jubilation by Nigerians over this step towards political oblivion by a political party that has brought so much pain on them.

    “Now that the APC has become defunct, the PDP invites the Independent National Electoral Commission (INEC) to officially deregister the APC and recall its certificate of registration, given that it no longer has operational structures as required by law.

    “In the same vein, INEC should immediately declare the seat of all lawmakers elected on the platform of APC at the federal and state levels as vacant and commence the process of bye-election to fill the seats, as required by law.

    “Furthermore, government agencies, civil society organizations as well as the international community should immediately gazette the APC as a defunct political organization in our country.

    “Nevertheless, the PDP invites all leaders of the fizzled APC to get ready to answer Nigerians for their misdeeds, and not to think they can get away with their atrocities by forming or joining another political party.”

    The House of Representatives, on Tuesday directed the National Insurance Commission (NAICOM) to put on hold the planned 31st December 2020 mandatory deadline for the first phase of 50%-60% of the minimum paid-up share capital for insurance and reinsurance companies.

    The House said the suspension will last for six months from January – June 2021 to soften the harsh effects of Covid-19 and other unforeseen circumstances on the insurance industry.

    The resolution followed the adoption of a motion of urgent national importance, titled, ‘Need to suspend the proposed Recapitalisation of Insurance Companies, Insurance Intermediaries and Other Players in the Insurance Sector, Especially in View of the Covid-19 Pandemic and the Economic Recession,’ sponsored by Hon. Benjamin Okezie Kalu and 15 others.

    Moving the motion, Kalu recalls that NAICOM issued a circular dated May 20, 2019 on the minimum paid-up share capital requirement for insurance and reinsurance companies.

    This circular, he said effectively increased the minimum paid-up share capital for insurance and reinsurance companies and the original deadlines were 29 May 2019 for new companies, while, 30 June, 2020 was to apply to existing companies.

    He listed the changes to the minimum paid-up share capital as follows, ‘Life Insurance N2 billion to N8 billion, General N3 billion to N10 billion, Composite N5 billion to N18 billion and Reinsurance N10 billion to N20 billion, which was later moved to 31 December, 2020.’

    Kalu noted that as a result of the Covid-19 pandemic, the deadline was moved by NAICOM, via circular with reference number: NAICOM/DPR/CIR/25-04/2020 and dated 3 June 2020.

    He expressed concerns that if NAICOM is allowed to proceed with its programme as planned, it could negatively affect the economy and slow down the recovery process.

    He said: ”In the Circular, NAICOM introduced a two phased recapitalisation programmes, wherein, 50 percent of the minimum paid-up share capital for insurance companies must be met by 31 December, 2020 and 60 percent for reinsurance companies must be met on the same date. Total compliance with the total minimum capital requirement must be achieved on or before 30 September 2021.”

    ”In addition to the negative economic impact of the Covid-19 pandemic, the Nigerian economy was just announced to be officially in a recession. This signifies that there will be significant slowdown in economic activities and the liquidity position of both the government and businesses are seriously impacted, albeit, negatively.

    ”In times as these, the best move by the government and by regulators is to push more liquidity into the economy in a bid to stimulate economic activities, encourage spending and prevent job losses as well as support the indigenous businesses in the country. This is pertinent because in addition to the impact of the COVID-19 pandemic, the industry was also affected by the aftermath of the ENDSARS protest in which several insured properties were affected and to this effect, most of these insurance companies have tons of liabilities to settle in order to fulfil their obligations so as not to deny the rights of these affected insured persons.

    ”These are the types of fiscal, monetary and regulatory approaches that are being adopted in most countries. Hence, it may not be suitable at this time for NAICOM to even proceed with its planned phased recapitalization programme because of the overall impact it may have on the already fragile economy and the insurance sector”, Kalu added.

    VCs Blame Corona virus for Delay of Audited Accounts Presentation

    The Vice Chancellors, VCs ,of some Federal Universities of the Nation have linked the delay in presenting their 2018-2019 Financial Audited Accounts to the office of the Auditor General of the Federation to covid-19 outbreak.

    Universities who appeared before the House of Representatives on Public Accounts Committee, (PAC) have blamed their inability to render their 2018-2019 financial audited accounts to the office of the Auditor General of the Federation on the outbreak of the dreaded Corona virus pandemic in the country.

    The VCs made this known on Tuesday, when they appeared before House of Representatives, Committee on Public Account.

    The Universities’ VCs which appeared include Federal University of Lafia, Nasarawa State, Federal University of Technology , Minna, Federal University of Petroleum Resources, Effurrun Delta State and Modibbo Adamu University of Technology Yola, Adamawa State respectively.

    The Committee presently conducting administrative Investigations on the audit queries raised against Ministries Departments and Agencies (MDAs) of the Federal Government had requested the Institutions to submit the following information/documents for examinations:

    *Approved Budget ( both appropriation and Internally Generated Revenue, IGR for 2018-2019)
    *Audited Account and Management Account (2018-2019)
    *Budget Performance Report (2018-2019)

    • Evidence of remittance of Audited Accounts to the Auditor General of the Federation.

    However, during the appearances of the Heads of the Institutions, they blamed the outbreak of the Coronavirus pandemic in the country which delayed the processes and in some cases the inability of their Governing Councils to meet and approved the available reports

    They pleaded for more time to conclude with their External Auditors for the rendition which the Committee accepted but summoned the External Auditor of the Federal University of Lafia, Nasarawa State over some infractions noticed in the 2018 Audited Account of the Institution, just they directed that a sub- Committee should visit the Institution for on-the-spot assessment of most of the projects claimed to have been executed.

    The Committee also frowned at the utilization of the Internally Generated Revenues (IGR) of some of the Institutions saying that it violated financial regulations Government, as alluded to by the office of the Auditor General of the Federation.

    At this point, the Chairman of the committee, Hon. Oluwole Oke counselled the VCs on the need to follow the provisions establishing the Universities to guide against running foul of the law as ignorance would not be accepted as an excuse.

    Human Rights Activist, Aisha Yesufu has responded to President Muhammadu Buhari’s statement while commending the Army for restoring peace in Nigeria.

    DayBreak recalls that President Buhari, on Monday, said his government will deal decisively with “any act of hooliganism hiding behind peaceful protests.”

    He said although his government believed in the rights of citizens to embark on peaceful protests, such must be done responsibly.

    Buhari stated these while virtually declaring open the Chief of Army Staff’s Annual Conference 2020 from the Presidential Villa, Abuja.

    Reacting to this while featuring on Arise TV on Tuesday, December 8, Yesufu said,”It is very disrespectful for our leaders that we vote for, to continue telling us all sort of things.

    ”If there is anywhere there is hooliganism in Nigeria, then it’s in the Aso Villa and the president is the one presiding it.

    ”That is not the language the president should be using.

    She also lamented the way the media reported the EndSARS protest.

    ‘She said, ’Why is the media enabling government in this tyranny. The protest was not hijacked, the Nigerian government led by Muhammadu Buhari brought in thugs to attack protesters.

    ”We saw the military, security agencies, police vehicles being used to transport thugs.

    ‘’The thugs went on a looting spree. The endsars protest was peaceful but the media joined in reporting that it was hijacked.”

    The national leader of the All Progressive Party (APC), Bola Tinubu has reacted to the death of the Nasarawa State APC Chairman, Philip Shekwo.

    Tinubu while commiserating with the Nasarawa State government in a tweet on Tuesday, December 8, expressed disappointment in the gruesome murder of Shekwo.

    He wrote, ”I commiserate with Governor Abdullahi and the government of Nasarawa State.

    ”I hope and pray that security agents will get to the bottom of this horrid killing and bring the perpetrators to book.

    ”I pray that Almighty Allah comfort them all. In particular, I pray that Allah stand by the wife and children, and indeed by all those left behind by the deceased.

    ”May the soul of Mr. Shekwo rest in the bosom of the Lord.”

    Recall that police officers have arrested the killer of of the Nasarawa State chairman of the All Progressives Congress (APC), Philip Shekwo.

    The All Progressives Congress, APC said on Monday that last Saturday legislative by-election in some states of the federation was a proof of acceptance of the party and President Muhammadu Buhari by the people.

    It said from Imo, Bauchi, Lagos, Plateau and other states where Saturday’s concurrent legislative by-elections were conducted across the country, the massive electoral victories recorded by the party is a solid display and pointer that the APC remains the only political party with a true national appeal and acceptance by Nigerians, across geo-political zones and sundry groupings. 

    The party speaking through its National Deputy Publicity Secretary, Yekini Nabena at the the party secretariat said as a governing party, the APC does not take the massive national support for granted. 

    “This is indeed a true demonstration that President Muhammadu Buhari and the APC government he leads remains massively popular with Nigerians, despite the warped narrative some opposition partisans try to sell.”

    According to the party spokesman, “thee President Muhammadu Buhari-led APC administration is further buoyed by this national support to improve the lives of Nigerians, genuinely address our challenges and overall, better our dear country.

    “Intra-party, the important work the Governor Mai Mala Buni-led APC Caretaker/Extraordinary Convention Planning Committee (CECPC) is doing to reposition the party by accommodating all interests and ensuring peace, unity, fairness, equity, justice and inclusion and internal democracy in our great party is undoubtedly beginning to yield fruits as the APC has been returned to winning ways and reemerging as a united, progressive and focussed political unit.”

    The party Expresses its sadness over the unfortunate boat mishap in Bayelsa State saying; “we received with sadness and regret the casualties resulting from the unfortunate boat mishap involving some policemen on election duty in Bayelsa state as well as some election irregularities in some states where the concurrent legislative by-elections held.

    “Although the by-elections were largely peaceful and hitch-free, we must continue to support the Independent National Electoral Commission (INEC) and other relevant bodies ensure the credibility and efficiency of our election processes. The APC continues to advocate against election illegalilites such as vote buying and other emerging frauds which the Peoples Democratic Party (PDP) and their agents are hellbent on foisting on our electioneering processes.”

    The party reiterated its efforts to make all valid votes count in  all further elections in the country adding, “valid votes must count and the majority will of the electorate must prevail.”

    Major international development organisations in Nigeria have expressed their readiness to partner the 9th House of Representatives in the implementation of its revised Legislative Agenda.
    This is as the Speaker, Rep. Femi Gbajabiamila, reiterated the commitment of the House to be people-centred in the process of law-making.

    These emerged on Monday during a roundtable with heads of international development agencies, where he stressed that the interest of Nigerians remained uppermost in any piece of legislation the House would pass.

    Some of the international development agencies at the roundtable included the World Bank; Delegation of European Union to Nigeria and ECOWAS; Japan International Cooperation Agency (JICA); Canadian International Development Agency (CIDA); Foreign, Commonwealth and Development Office (FCDO); and the United Nations Office for Drugs and Crime (UNODC).

    Others were Mercy Corps, GIZ Nigeria, National Democratic Institute (NDI) and Partnership to Engage, Reform and Learn (PERL)-Engage Citizens Pillar (ECP) and the United Nations Development Programmes (UNDP).

    In his opening remarks, Gbajabiamila explained the drive behind the need for the involvement of the Nigerian people in every piece of law from the House, saying, “When I became Speaker in June last year, I committed to broad reforms of government and governance infrastructure in Nigeria.”
    “I believed then, and I still believe that until we fix the way we run the government in Nigeria, we will always be limited in our ability to meet our people’s expectations regardless of our best interests.“

    To be effective, the House needed to plan and work towards that plan, rather than stay in a reactionary position where our interventions are motivated by the demands of the news cycle. This commitment inspired me to appoint a Special Committee to draft a Legislative Agenda for the House to debate, amend, and adopt as our action plan.
    “Afterwards, we presented the Agenda to the Senate, the Executive, Judiciary and the general public. We wanted the Legislative Agenda to be a public document, open to discussion, and criticism. We also wanted to make our governing intentions known, so those who had any interest, ideas, and contributions could reach out to work with us.”

    According to him, the House was proactive by reviewing the Legislative Agenda due to the outbreak and effects of the coronavirus pandemic.
    This, he said, resulted in the revised 9th Legislative Agenda with 10 priority areas, namely healthcare; education; security; economy; sustainable power; human capital development and social investment; agriculture and food security; environment and climate change; governance; and reform of the House of Representatives.

    According to the Speaker, the new approach adopted by the House to pass a bill begins with engaging Nigerians in discussions on the bill before it gets to the floor of the House.

    He then invited the agencies present to join hands to help Nigeria become a more robust democracy – secure, economically-resilient and confident of its place in the world.
    In his reaction, World Bank’s Country Director, Shubham Chaudhuri, who noted that the document was timely, considering the effect of the coronavirus pandemic, expressed the readiness of the bank to work with the House on the implementation of the priority areas.

    He, however, urged the Speaker to ensure that private sector participation, investment in the people and the provision of infrastructure were given more attention.
    On his part, Head of Section, Delegation of EU to Nigeria and ECOWAS, Mr Clement Boutilier, also noted that the document was a welcomed development, clear and well-driven.

    Boutilier noted that the document’s priority areas in agriculture, security and security reform were in concert with the programmes of the EU, especially with the new EU’s approach on how to mobilise and facilitate private investment in Nigeria.
    UNDP’s Country Director, Samuel Bwalya, said the revised Legislative Agenda was thoughtful and proactive because it was all about making Nigerian institutions work.

    Earlier in his remarks, the Chairman, House Committee Implementation and Monitoring of the Legislative Agenda, Rep. Henry Nwawuba, said that 9th Legislative Agenda was different from others before it because it must be implemented in line with another document, ‘Contract with Nigerians’, that set out the roadmap and timelines for the implementation of the priority areas of the Agenda.

    “We had Legislative Agenda in the other Assemblies. We had it in the 7th and the 8th assemblies. However, what is different this time is that Mr Speaker has identified persons, who must be held responsible for the implementation of the agenda.
    “The Agenda is a contract with the Nigerian people, to be reported to them at the end of this 9th Assembly. There is a commitment for the House to work faster to achieve the targets it set for itself at the beginning of the 9th Assembly in June 2019”, he said.

    Nwawuba cited the case of the Petroleum Industry Bill, which he said the Speaker had stressed on the plan of the House to pass it by the second quarter of 2021.
    “We will do whatever it takes to pass the PIB”, he assured the session.

    The Peoples Democratic Party (PDP) Caucus in the House of Representatives has called on Nigerians to compel those elected to represent them in the National Assembly to commence impeachment proceedings at once against President Muhammadu Buhari for gross incompetence, persistent and continuous breach of Section 14(2)(b) of the 1999 Constitution.
    The Section provides ” the security and welfare of the people shall be the primary purpose of government; …”

    The PDP caucus also wants members of the Federal Executive Council to invoke the provisions of Section 144 (1) of the Constitution by declaring that the President is incapable of discharging the functions of the office of President of the Federal Republic of Nigeria.

    The Section provides ” The President or Vice-President shall cease to hold office, if- by a resolution passed by two-thirds majority of all the members of the executive council of the Federation, it is declared that the President or Vice-President is incapable of discharging the functions of his office: “

    Leader of the caucus, Hon. Kingsley Chinda (PDP, Rivers) said in a statement in Abuja on Saturday that it was disheartening to the PDP Caucus that the President has failed to lead Nigerians from the front as he promised. Nigerians are daily and defencelessly killed by terrorists and bandits, while the economy is being freely bled by public officers.

    Rep. Chinda, was on behalf of the Caucus reacting to the recent killing of farmers in Zambarmari area of Borno state, adding that the reactions of the presidency and the military to such killings “highlight a certain crassness and lame duck attitude that has for the past five years come to define the Buhari presidency”.

    He said that the body language of the government is worrisome as it emboldens terrorists in the country, the greater worries for the country however, is “the do-nothing posturing and the effeminate reactions of the presidency and the military that follow the dastardly attacks.”

    He said: “The Peoples Democratic Party (PDP) Caucus in the House of Representatives have observed with deep pain the dastardly attacks on poor farmers which have continued unabated across the vast swathes of northern Nigeria, which act came to a sad climax over the weekend in Zabarmari, near Maiduguri, north east Nigeria.”

    “The attacks continue to take a consistent pattern – a pattern that results in mass deaths and emboldens the insurgents to embark on more spectacular attacks that provide them national and global attention. While the emboldening of terrorists remain sources of worry, the greater worries for us is the do-nothing posturing and the effeminate reactions of the presidency and the military that follow the dastardly attacks.”

    “The reactions of the presidency and the military highlight a certain crassness and lame duck attitude that has for the past five years come to define the Buhari presidency,” the statement said.

    It further expressed regrets that “Northern Nigeria has long become the vortex of massacres. From Buni Yadi, Gamboru, Baga, Gwoza, Shiroro, Konduga, Kawuri, Southern Kaduna to Benue and certainly everywhere else in Nigeria, lives are being snatched by insurgents, bandits and kidnappers who have no respect for the sanctity of life. “

    “While President Buhari idles in the typical fashion of Emperor Nero as our country burns. Questions must be asked about his capacity to lead at a time that our country desires robust and responsible leadership that can pull it from the brink and rescue it from the debilitions of insurgents, terrorists, bandits and kidnappers.”

    “President Buhari is unwilling, (as it consistently appears,) to provide leadership to our fast collapsing country. Rather than take the proverbial bull by the horn, President Buhari ensconces himself in Aso Rock, typical of a Mourner-in-Chief, and issues press statements that make no meaning to a grieving nation”.

    The lawmakers reminded the President that “a true leader who is worth every ounce of respect leads from the front as you assured Nigerians that you will do; a true leader doesn’t hide away from those he leads and pretends to mourn with the circus, whilst in fact, he lacks empathy and compassion.”

    “When a country elects a clown as its President based on sentiments and deceit, the country becomes saddled with circus, pantomime jesters who reduce statecraft to utter joke.

    “Our country is in the grips of the clowns, hyenas and the circus is on.
    We need to rescue Nigeria from the clowns, acrobats, trapeze actors, hawks and hyenas manipulating the statecraft”, the statement added

    It further stressed: “As Vice-president Yemi Osibanjo SAN tweeted ‘if the President says I’ve lost the capacity to guarantee the security of lives and property, it’s certainly an impeachable offence”.

    “Most painful is that whilst leadership is completely absent in Nigeria and the country dovetailing to a state of survival of the fittest, the economy is being fleeced in an unprecedented manner by public office holders.

    “Recall the warning by Albert Einstien that ‘the world will not be destroyed by those who do evil, but by those who watch them without doing anything’.

    “We call on Nigerians across tribe, religion and political party to wake up their National Assembly Members” and compel them to commence impeachment process against President Buhari to save Nigeria, the statement signed by Rep Chinda urged.

    Bye-elections: Why elections are declared inconclusive– INEC

    The Independent National Electoral Commission (INEC) has explained why elections in Nigeria are sometimes declared inconclusive.

    INEC stated this while reacting to the recently conducted bye-elections conducted across eleven states of the country on Saturday, 5th December 2020.

    In a communique on Sunday, December 6, INEC’s National Commissioner and Chairman on information and Voter Education Committee, Mr Festus OkoyeIt said that some unscrupulous individuals are bent on disrupting the elections.

    According to Mr Okoye, a number of the Commission’s staff were assaulted during the bye-elections.

    “In some areas, the staff of the Commission were assaulted and materials destroyed, while in others there was resistance to the use of the Smart Card Readers.

    “In yet other areas, Commission staff were prevented from deploying altogether. In fact, in one area in Lagos State, some people demanded for money from INEC staff before they would be allowed to deploy.

    “These acts continue to reflect poorly on our country and denude the spirited efforts of the Commission to improve the electoral process under very difficult circumstances,” Okoye’s communique partly read.

    Okoye revealed that one consequence of the lingering problem of election disruption manifested in the declaration of the bye-election for Bakura State Constituency in Zamfara State inconclusive.

    “The Returning Officer declared the result inconclusive in line with the Electoral Act 2010 (as amended) and the Commission’s Regulations and Guidelines for the Conduct of Elections.

    “The election for Bakura State Constituency became inconclusive because the 2,181-vote margin between the two leading candidates – those of the PDP (18,645 votes) and APC (16,464) – is less than the total number of registered voters in 14 Polling Units where elections were cancelled or not held, which stands at 11,429.

    “Consequently, by the “margin of lead principle”, the election could not be declared and no winner was returned.

    “Voting in the 14 affected Polling Units was marred by over-voting, abduction of staff of the Commission, violence, assault occasioning grievous hurt against INEC officials, burning of INEC materials and snatching and carting away of sensitive electoral materials, resistance to the use of smart cards readers and obstruction of the electoral process,” Okoye revealed.

    The Commissioner further stated that the Commission met on Sunday, 6th December 2020 and decided to remobilize and conclude the elections on Wednesday, 9th December 2020.

    He stressed that in order to ensure that the Supplementary Election is properly secured, the Commission is considering clustering the affected Polling Units to prevent the disruptions experienced on 5th December 2020.

    According to the INEC spokesman, the details for the conclusion of the bye-election in Bakura will be worked out by the INEC State Office in Gusau after consultation with stakeholders.

    Mr Okoye said the Commission has commiserated with staff who were assaulted and has also extended its deep condolences to the families of the six policemen who lost their lives when the boat in which they were escorting election staff and materials capsized in Bayelsa State.

    The bye-elections on Saturday involved nine State House of Assembly seats and six Senatorial seats.

    The results of all the House of Assembly seats have been declared, except for Bakura State Constituency in Zamfara State.

    Also, the results of four Senatorial seats have been successfully declared and INEC hopes that the results of the other Senatorial seats would be declared soon.

    The Commission through its spokesman assured that as has become part of its practice, the results of the elections will be available on the INEC website during the week.
