“Osun re-run was illegal”: highlights of the tribunal’s decision

Highlights of the Ruling:

*Upholds PDP’s claims of alteration of results*

* upheld claims by the Peoples Democratic Party, PDP that results of the Osun governorship elections were altered.

The tribunal held that testimonies by agents of the APC, who were witnesses at the tribunal showed that Forms EC8A and EC8B were altered after the completion of the election.

The Tribunal noted the discrepancies between the EC8A Pink copies tendered by PDP and the CTC issued by INEC.

The Tribunal holds that the CTC should and must be an exact replica of the EC8A pink copies. The discrepancies must therefore be explained and justified by the 1st respondent ; INEC.

In this instant INEC failed to explain nor justify the alterations and that they failed to call any witness to justify the alterations.

It therefore holds that the alterations must have been carried out in the absence of the Party Agents to which the Pink copies were issued.

It holds further that the attempt to explain the alterations on the basis of mere corrections of errors is not acceptable and the fact that the said errors were consistently made in the disputed areas means it was a deliberate action taken.

PDP’s allegations of doctoring of results is hereby established and upheld by the Tribunal

On APC’s application that Senator Adeleke was not qualified to contest the Governorship election in the 1st place.

TRIBUNAL holds that the APC failed to provide any evidence as proof of this allegation, insisting HE WHO ALLEGES MUST PROVE.

The Tribunal cancelled the result of 17 polling units thereby deducting 2,227 from APC votes and 1,246 votes from PDP votes

On whether there should have been rerun election on September 27, Tribunal cancelled 27 September 2018 re-run Election.

Tribunal: The rerun election was unlawful

Cancellation of 7 units is unlawful…rerun election cannot stand. It is a product of illegality.

Based on principles established by the Tribunal so far…

1. Established mutilations of CTC of EC8AS by INEC.

2. Wrong cancellation of elections in 7 Polling Units by Returning officer instead of the PU Presiding officer.

The Tribunal cancelled the result of 17 polling units thereby deducting 2029 from APC votes and 1246 votes from PDP votes = 783 votes in favour of Adeleke on the lead.

Summary
PDP. APC
255,023. 255, 505
– 1,246. – 2, 029
—————– —————
= 253,777. 253,476

Making a total of valid votes in favour of Adeleke at 301 votes
