    FG Collaborating With US on Possible Extradition of Abba Kyari – AGF, Malami

    The Attorney General of the Federation and Minister of Justice, Abubakar Malami (SAN), says the United States Government and the Nigerian Government are discussing the possible extradition of the suspended Head of the Intelligence Response Team, DCP Abba Kyari, for his alleged role in a $1m scam allegedly perpetrated by alleged international Internet fraudster Ramon Abbas, aka, Hushpuppi and five others.

    The AGF also said reasonable grounds for suspicion have been established against Kyari.

    In July 2019, the Federal Bureau of Investigation (FBI) had revealed how Kyari allegedly collaborated with Hushpuppi, a self-confessed international fraudster, to jail one of the latter’s associates, “after a dispute over a $1.1 million scam on Qatari business people”.

    The suspended police officer had, however, denied the allegation, claiming that his “hands are clean”.

    In August 2021, Usman Baba, inspector-general of police, received the report of a panel set up to probe the bribery allegation against Kyari.

    Days later, Muhammad Dingyadi, minister of police affairs, said the panel report on Kyari had been submitted to Malami.

    Speaking on the report on Monday, the attorney-general, in an interview on Channels Television, said the panel has established “reasonable ground for suspicion” which could lead Kyari’s extradition.

    “There are a lot of issues that are ongoing, inclusive of the possibility of consideration for extradition and associated things. That is where the collaboration element of it comes into play in respect of all the two cases,” he said.

    Asked if there is a possibility of extradition, the minister said: “there could be a need or perhaps the possibility of making such request and they are looking into it.”

    Asked if the extradition request has been made, Malami said discussions on the matter are ongoing.

    “As far as I’m concerned, the parties are discussing, the parties are collaborating and there is an exchange of correspondence from the perspective of investigation, from the perspective of extradition, and associated things,” he said.

    “You can’t find someone guilty but perhaps the reasonable ground for suspicion can be established, which would translate to prosecution.

    “That is what we are talking of — reasonable grounds for suspicion. Reasonable grounds for suspicion has been established; that will eventually translate to the possibility of prosecution and eventually conviction if indeed at the end of the day, one is adjudged guilty by the court of law.

    “The position now is that there is prima facie reasonable ground for suspicion that has been considered from the perspective of prosecution, and for extradition if the need for so doing arises. That is what is unfolding in terms of international collaboration.”

    US Court postpones sentencing of Hushpuppi by five months

    The United States Attorney’s Office at the Central District of California has postponed the sentencing of alleged international Internet fraudster Ramon Abbas, aka, Hushpuppi by five months.

    The court’s Director of Media Relations, Thom Mrozek, in response to an email inquiry by The PUNCH late Thursday, said the date which was initially scheduled for Valentine’s Day, has been moved to July 11, 2022.

    “The sentencing hearing that was scheduled for later this month has been delayed,” Mrozek told.

    Court document showed that Judge Otis D. Wright in Los Angeles granted the order for postponement after Hushpuppi’s lawyers led by Louis Shapiro entered a request for postponement.

    “At the request of counsel, the sentencing is continued to July 11, 2022 at 11:00 a.m. It is so ordered,” the document partly read.

    Also, in a plea agreement document, Hushpuppi pleaded guilty to various offences bordering on internet scam and money laundering, among others.

    It stated that Hushpuppi risks “20 years’ imprisonment; a 3-year period of supervised release; a fine of $500,000 or twice the gross gain or gross loss resulting from the offence”.

    The Dubai Police in the United Arab Emirates had in June 2020 arrested Hushpuppi and his gang. They were later extradited to the US for prosecution by the FBI.

    The FBI Special Agent, Andrew Innocenti, had alleged that Hushpuppi contracted the services of Kyari after a “co-conspirator,” Chibuzo Vincent, allegedly threatened to expose the alleged $1.1m fraud committed against a Qatari businessman.

    Innocenti, who said he obtained voice calls and WhatsApp conversations between Kyari and Hushpuppi, had also alleged that the latter paid the police officer N8m or $20,600 for the arrest and detention of Vincent.

    Kyari had taken to Facebook on July 29, 2021 to deny the allegations, but he later deleted the post after editing it about 12 times.

    The IG had recommended the suspension of Kyari, which the PSC carried out on July 31, 2021.

    The police boss had on August 2, 2021, constituted the Special Investigation Panel headed by the Deputy Inspector-General of Police in charge of the Force Criminal Investigations Department, Joseph Egbunike, to probe the allegations.

    Egbunike on August 26, 2021 submitted the panel’s report, which he said “is an outcome of a painstaking, transparent and exhaustive investigative process.”

    He revealed that the report contained the case file of the probe, evidence and findings as well as testimonies from Kyari and other persons and groups linked to the matter.

    The Minister of Police Affairs, Maigari Dingyadi, had on September 14, 2021, during a television interview said the findings and recommendations on Kyari had been submitted to the Attorney-General of the Federation, Abubakar Malami (SAN), for “legal opinion” and thereafter for presentation to the President, Major General Muhammadu Buhari (rtd.), adding that the final decision would be taken by the PSC.

    But months later, the PSC spokesman, Ikechukwu Ani, told our correspondent that the commission had not received any disciplinary recommendations from the IG through the Force Disciplinary Committee almost four months after the Egbunike panel submitted its report to the police boss.

    The recommendations of the FDC will inform the commission’s decision and also determine Kyari’s future in the force, but the matter is now inconclusive.

    The PUNCH had reported that Kyari, on Saturday, attended the wedding of Maina, son of the IGP, and splashed over 400 photos he took at the wedding on his verified Facebook page.

    Arrested Nigerian fraudster, Ramon Abass, popularly known as Hushpuppi will be sentenced on Valentine’s day.

    According to BBC Pidgin, the news was confirmed by United States Attorney’s Office at the Central District of California and the court’s Director of Media Relations, Thom Mrozek.

    A plea agreement document signed by Hushpuppi; his lawyer, Loius Shapiro; Acting United States Attorney, Tracy Wilkison, amongst others, revealed that he pleaded guilty to internet scam and money laundering, among others.

    Hushpuppi, who was arrested in 2020, risks getting a 20 years jail sentence; a 3-year period of supervised release; a fine of $500,000 or twice the gross gain or gross loss resulting from the offence.

    Suspended former Head of the Intelligence Response Team, DCP Abba Kyari, has deleted his latest Facebook post just as the Inspector-General of Police, Usman Baba, received the report of the Special Investigation Panel on the indictment of the deputy police commissioner in a $1.1m Internet scam allegedly carried out by an Instagram influencer, Abbas Ramon aka Hushpuppi and four others.

    Kyari had on Thursday resumed on social media after a three-week break. His last Facebook post was on August 4, 2021, which he had deleted almost immediately and disappeared from the Blueville.

    However, the Borno State indigene took to his verified Facebook page with over 450,000 followers on Thursday.

    Kyari shared a 21-second hilarious TikTok video posted by one Sanda Tobacco wherein a cart pusher was videoed displaying some roller skating skills while the videographer laughingly said the cart pusher “is very crazy wallahi!”.

    But the post was no longer on his page as of the time of filing this report.

    Recall that the Federal Bureau of Investigation Special Agent, Andrew Innocenti, had alleged that Hushpuppi contracted the services of Kyari after a “co-conspirator,” Chibuzo Vincent allegedly threatened to expose the alleged $1.1m fraud committed against a Qatari businessman.

    Innocenti, who said he ransacked the voice calls and WhatsApp conversations between Kyari and Hushpuppi, had also alleged that the latter paid the police officer N8m or $20,600 for the arrest and detention of Vincent.

    Kyari had taken to Facebook on July 29, 2021, to chronicle his denial against the allegations but he later deleted the post after editing for about 12 times.

    The IGP had on August 2, 2021, constituted the Special Investigation Panel headed by the Deputy Inspector-General of Police in charge of the Force Criminal Investigations Department, Joseph Egbunike, to probe the allegations.

    Egbunike on Thursday submitted his findings which he said “is an outcome of a painstaking, transparent and exhaustive investigative process.”

    He revealed that the report contained the case file of the probe, evidence and findings as well as testimonies from Kyari and other persons and groups linked to the matter.

    The police are expected to transfer the report to the Police Service Commission which had equally set up an in-house panel to study documents related to the indictment of Kyari by the FBI.

    The Inspector-General of Police, Usman Baba, has received the report of the Special Investigation Panel on the alleged indictment of the erstwhile Head of the Police Intelligence Response Team, Abba Kyari, a deputy commissioner of police, by the Federal Bureau of Investigation.

    The report was submitted by the chairman of the SIP, DIG Joseph Egbunike, at the Force Headquarters, Abuja, on Thursday.

    A statement by the force spokesman, Frank Mba, titled, ‘IG receives panel report on DCP Abba Kyari,’ said Egbunike appreciated the IG for the confidence reposed in him and the members of the panel.

    He noted that the panel commenced investigations immediately it was inaugurated on August 2, “and the report submitted is an outcome of a painstaking, transparent and exhaustive investigative process.”

    He further revealed that the report contained the case file of the probe, evidences and findings as well as testimonies from Kyari and other persons and groups linked to the matter.

    The statement said, “The IGP, who commended the panel for the work done, stated that the essence of the probe was to carry out discrete investigations into the allegation levied against the officer to enable the Force leadership be appropriately guided in its decision-making processes.

    “The IGP assured that a careful and expeditious review of the recommendations would be undertaken by the Force Management Team and thereafter, forwarded to appropriate quarters for necessary action(s). He reiterated as always, the commitment of the Force to justice for all.”

    An FBI agent, Andrew Innocenti, had in a document titled, ‘Criminal Complaint By Telephone Or Other Reliable Electronic Means’ filed before the United States District Court for the Central District of California, alleged that a suspected fraudster, Abas Ramon, aka Hushpuppi, contracted Kyari to detain a co-conspirator, Chibuzo Vincent, for threatening to expose the alleged $1.1m fraud committed against a Qatari businessman.

    The agency said Hushpuppi paid $20,600 into a bank account provided by Kyari.

    Following the allegations, Kyari was suspended from service on July 31 by the Police Service Commission. He also appeared before the SIP over several days.

    The police are expected to submit the panel report to the PSC for further action.

    The Police Service Commission has set up a panel to probe the suspended Deputy Commissioner of Police, Abba Kyari.

    Kyari, a former head of the Intelligence Response Team (IRT) of the Nigeria Police Force, was suspended after an indictment by the FBI over bribery allegations linked to suspected billionaire fraudster, Abbas Ramon, also known as Hushpuppi.

    Daybreak reports that after his suspension, he was probed by a Police Investigative Panel set up by the Inspector-General of Police (IGP), Usman Baba.

    The panel was headed by Joseph Egbunike, a Deputy Inspector-General of Police.

    However, a fresh panel which was set up by the PSC is being headed by Bar. Tijani Mohammed, Director, Department of Police Discipline in the Commission and the Panel has been inaugurated by the Permanent Secretary/ Secretary to the Commission, Alhaji Abubakar Ismaila.

    According to a statement issued by the spokesman of the commission, Ikechukwu Ani, the new panel is expected to examine the facts of the allegations as contained in the FBI indictment.

    The new panel will also to look at the extant rules as a ”means of keeping abreast of the matter” pending the submission of the report by the Police Investigative Panel.

    Ani also said the probe panel has as its terms of reference; to gather and document relevant information on Kyari in view of his disciplinary matter and to analyze the information gathered and make appropriate recommendation(s) to the Commission.

    The statement read, ”The report of the in-house panel is expected to assist the commission take an informed decision when the Police Investigative Panel Report is submitted for the Commission’s consideration.

    ”The Commission had earlier suspended DCP Kyari, former Head, Intelligence Response Team, IRT, of the Nigeria Police Force. The suspension which took effect from Saturday, July 31st, 2021, according to the Commission is to subsist pending the outcome of the investigation in respect of his indictment by the Federal Bureau of Investigation of the United States.”

    The commission also directed the Inspector-General of Police to furnish it with information on further development on the matter.

    The Special Investigation Panel has submitted its report to the Inspector-General of Police, Usman Baba, two weeks after it was mandated to probe the former Head, Intelligence Response Team, Abba Kyari, a Deputy Commissioner of Police.

    The four-man panel headed by the Deputy Inspector -General of Police in charge of the Force Criminal Investigations Department, Joseph Egbunike, submitted its findings to the IG on Monday.

    Kyari is under investigation for his alleged involvement in a $1.1m Internet fraud allegedly perpetrated by an Instagram influencer, Abbas Ramon, popularly known as Hushpuppi and four others; AbdulRahman  Juma (Abdul); Vincent Kelly Chibuzo (Kelly); Rukayat Motunrayo Fashola (Morayo); and Bolatito Agbabiaka (Bolamide).

    The FBI had claimed that Kyari detained Chibuzor at the behest of Hushpuppi for one month to enable the latter and his co-conspirators to fleece their Qatari victim of over $1m.

    Following the development, the IG on August 1 recommended the suspension of the DCP to the Police Service Commission, with effect from July 31, and also set up the SIP to investigate the allegations against him.

    Kyari was replaced at the IRT by Tunji Disu, also a DCP

    During its sittings, Kyari appeared several times before the panel where he dismissed the allegations of conniving with Hushpuppi to defraud the Qatari businessman.

    Our correspondent gathered that the SIP sessions with Kyari were relaxed and cordial, a situation that gave the DCP the confidence that he would be absolved of the allegations.

    Sources said Egbunike and Kyari had a long term relationship since the former was an Assistant Commissioner of Police in the police Accounts Department where he served for over 15 years.

    It was learnt that the panel submitted the report last week but it was rejected by the IG for being too lenient on Kyari.

    A source stated, “The panel concluded its investigation and submitted its report to the IG last Thursday or Friday but the IG rejected it. He was not comfortable with the panel findings and recommendations.

    Hushpuppi: Northern Lawyers to Provide Free Legal Services for Abba Kyari

    A group of Northern Nigerian lawyers have volunteered to render free legal services to the suspended Deputy Commissioner of Police, Abba Kyari.

    The group in a statement issued Wednesday in Abuja and signed by its coordinator, Barrister Sunusi Salisu, said the lawyers were drawn from across all the 19 northern states and all religions and tribes to render free legal services for the preservation of Kyari’s fundamental rights that may be potentially jeopardized by his alleged indictment by a court in the United States of America.

    The lawyers said they would critically review the procedures adopted by the Federal Bureau of Investigations (FBI) to get the US Court to indict Kyari on allegations of involvement in charges filed against a suspected fraudster, Ramon Abbas Hushpuppi.

    The group said: “We would raise questions involving the possibility of the occasioning of breaches to Kyari’s fundamental rights entrenched in Articles 6 and 7 of the African Charter on Human and Peoples Right which essentially state that every individual shall have the right to liberty and to the security of his person and every individual shall have the right to have his cause heard.

    “This comprises: The right to an appeal to competent national organs against acts of violating his fundamental rights as recognized and guaranteed by conventions, laws, regulations and customs in force.

    “The right to be presumed innocent until proven guilty by a competent court or tribunal; the right to defence, including the right to be defended by counsel of his choice; the right to be tried within a reasonable time by an impartial court or tribunal.”

    The lawyers said they would weigh the procedures against the intendment of Section 36(1) of the 1999 Constitution of the Federal Republic of Nigeria (as amended), which specifically stated that, in the determination of his civil rights and obligations, including any question or determination by, or against any government, or authority, a person shall be entitled to fair hearing within a reasonable time by a court, or other tribunal.

    Davido’s Personal Logistics Manager, Isreal Afeare aka Israel DMW, has begged Nigerians to plead with his boss following reports he has been sacked.

    There have been allegations the DMW boss sacked Israel DMW after he took to social media to drag the FBI following the order to arrest Deputy Commissioner of Police, Abba Kyari for his alleged involvement with the popular fraudster, Hushpuppi.

    According to Israel, Nigerians are not helping the situation with their negative comments about him on social media.

    Speaking further, Israel said he is currently depressed and Nigerians should apologise to Davido on his behalf.

    Israel, who is known for his constant praise-singing of his boss, also apologised to the “Jowo” singer, adding he was oblivious of the gravity of his deed until Ubi Franklin called his attention to it.

    He wrote: “You people should kindly help me beg my oga not to sack me, tru his personal lawyer Jiggy, than adding to my current depression of pressuring him to send me off.

    “What would be you people’s gains, after 9 good years? I never knew the gravity of my actions, until Ubi Franklin personally called to tell me. Am very sorry sir.”

    BREAKING: Police commission suspends Abba Kyari Over FBI Indictment

    Abba Kyari, a Deputy Commissioner of Police and Head, Intelligence Response Team (IRT) of the Nigeria Police Force, has been suspended over the indictment by FBI.

    In a criminal complaint lodged at the United States District Court in California, FBI had listed Kyari among six suspects indicted in an international fraud conspiracy.

    The fraud was said to have been orchestrated by Ramon Abbas, Instagram celebrity, better known as Hushpuppi.

    According to FBI, Hushpuppi, who is currently standing trial in the US, had sent some money to Kyari to help track down one of his rivals.

    Although Kyari had denied the allegation, the FBI had asked Nigerian authorities to arrest him.

    In a statement on Sunday, Ikechukwu Ani, spokesman of the Police Service Commission, said Kyari’s suspension took effect on Saturday.

    “Abba Kyari’s suspension took effect from Saturday, July 31st 2021 and would subsist pending the outcome of the investigation in respect of his indictment by the Federal Bureau of Investigation of the United States.”

    “The Commission has also directed the Inspector General of Police to furnish it with information on further development on the matter for necessary further action.

    “The Commission’s decision which was conveyed in a letter with reference, PSC/POL/D/153/vol/V/138 to the Inspector General of Police today, Sunday, August 1st, 2021, was signed by Hon. Justice Clara Bata Ogunbiyi, a retired Justice of the Supreme Court and Honourable Commissioner 1 in the Commission for the Commission’s Chairman, Alhaji Musiliu Smith, a retired Inspector General of Police who is currently on leave,” the statement read.
