    Igboho’s Aides Sue DSS, Seek N100m As Compensation

    The 12 associates of Yoruba nation agitator, Sunday Adeyemo, also known as Sunday Igboho, have instituted a rights enforcement suit against the Department of State Services (DSS) for parading them before the media as criminals.

    They filed the suit on Wednesday before Justice Obiora Egwuatu of the Federal High Court who presided as a vacation judge while the court is on recess.

    In the suit, Igboho’s associates sought a declaration of the court that their detention beyond 48 hours and their media parade without a court conviction, constituted a breach of their fundamental rights.

    They also sought an order of perpetual injunction restraining the DSS from interfering with their personal liberty and freedom of expression.

    Similarly, the applicants prayed for an order granting the sum of N100 million for aggravated and exemplary damages against the security outfit, for what they termed a serial breach of their constitutional rights.

    But the DSS lawyer, Idowu Awo, told Justice Egwuatu during the proceedings that his case file was stolen from a member of the legal team who was meant to bring it to the court.

    According to him, his colleague in question boarded a vehicle on Tuesday belonging to criminal elements, known as ‘one chance’, to whom she lost her personal belongings and the case file.

    With the annual recess of the court ending soon, Justice Egwuatu ruled that the file of the fundamental rights suit be returned to the registry for reassignment to the regular court.

    On July 1, Reports had it that there was tension in the Soka area of Ibadan as a result of the early-morning firefight at Igboho’s house.

    Hours after the incident, the DSS issued a statement in which it said it was a raid by a joint team of security operatives.

    It alleged that Igboho and others had plotted to wage a violent insurrection against the Nigerian State, calling on the Yoruba Nation agitator to turn himself in, at the nearest security agency.

    Igboho’s associates were later paraded and detained until eight of them were released by the DSS on August 30, after about two months in detention.

    The security agency had, however, kept four others in custody, although the court granted bail to all 12 persons.

    Last Friday, the DSS released two more aides of Igboho, bringing the total number of those that have left its custody to 10.

    The Department of State Services (DSS) has filed five counts of terrorism against two of the aides of Yoruba Nation agitator, Sunday Adeyemo, also known as Sunday Igboho.

    The charges were filled against them at the Federal High Court in Abuja

    Defendants in the charges are Jamiu Noah Oyetunji and a house wife, Mrs Amudat Habibat Babatunde.

    However, no date has been fixed for their arraignment.

    Court Strikes Out DSS Suit Seeking Further Detention Of Four Igboho’s Aides

    A Federal High Court in Abuja has struck out a suit filed by the Department of State Services (DSS) seeking to further detain four of the 12 aides of Yoruba nation agitator, Sunday Adeyemo, who is also known as Sunday Igboho.

    The motion was thrown out by Justice Obiora Egwuatu on Tuesday following the dramatic withdrawal by counsel to the security agency, Mr Idowu Awo.

    At the resumption of the case, the DSS lawyer stunned the court just as the motion was about to be heard, announcing his decision not to go ahead with the matter.

    Rather, he informed the court that he had filed a notice of appeal against the bail granted to four out of the 12 detainees.

    Awo stated that he would prefer to pursue the appeal at the Court of Appeal.

    Thereafter, Justice Egwuatu struck out the motion following the no objection by the detainees’ lawyer, Mr Sunday Adebayo.

    In early August, an Oyo State High Court granted an ex-parte motion prohibiting the DSS and Attorney-General of the Federation (AGF), Abubakar Malami, from arresting Sunday Igboho.

    The court also went further to restrain the DSS and Malami from freezing Igboho’s financial assets, as well as restrict any form of intimidation and harassment by the duo.

    The DSS paraded Sunday Ighoho’s aides on July 1 after a raid on his home in Ibadan, the Oyo State capital.

    During the operation, the security operatives arrested 12 of them and moved them to Abuja where they were detained.

    The detainees were accused of stockpiling arms to cause chaos in the country.

    Thereafter, the suspects filed an application through their lawyer, Mr Pelumi Olajengbesi, in which they prayed the court to inquire into the circumstances that led to their arrest and detention since July 2.

    Olajengbesi had also prayed the court to admit his clients to bail, a request that was granted by Justice Egwuatu on August 4.

    Judge signs release order of Igboho’s aides after 53 days in DSS custody

    After 53 days in the custody of the Department of State Services, four of the 12 aides of embattled Yoruba Nation agitator, Sunday Adeyemo aka Sunday Igboho, are set to taste freedom again as Justice Obiora Egwuatu of the Federal High Court, Abuja on Monday signed their Release Order.

    Report gathered that the presiding judge ignored the persistent argument of the DSS lawyer, Idowu Awo, and signed the Release Order of the four contested detainees.

    They are Amudat Babatunde, Abideen Shittu, Jamiu Oyetunji, and Bamidele Sunday.

    The detainees’ lawyer, Pelumi Olajengbesi, confirmed the development to our correspondent on Monday.

    He said the judge could not sign the Release Order of the other eight detainees because three of the sureties withdrew before concluding the process of perfecting the bail conditions of his clients.

    The eight detainees are Abdullateef Onaolapo, Tajudeen Irinloye, Dikeola Ademola, Ayobami Donald, Uthman Adelabu, Olakunle Oluwapelumi, Raji Kazeem, and Taiwo Tajudeen.

    Olajengbesi, however, expressed optimism that the three sureties that pulled out would be replaced and the judge would sign their Release Order too.

    The lawyer also urged the DSS to comply with the court order and release his clients immediately.

    Recall that the DSS had approached a Court of Appeal sitting in Abuja to revoke the bail earlier granted by the Federal High Court in Abuja to the contested four — Babatunde, Shittu, Oyetunji and Sunday.

    The secret police had expressed strong dissatisfaction against the ruling of Justice Egwuatu on August 4, 2021, granting bail to all the detainees, against the objection of the DSS lawyer that Babatunde, Shittu, Oyetunji and Sunday should not be granted bail.

    While Awo did not oppose the bail of the other eight, he had said investigations revealed that the four contested detainees — Babatunde, Shittu, Oyetunji and Sunday — were heavily involved in the alleged offence of arms stockpiling and other criminal activities of their boss, Igboho.

    But Justice Egwuatu had on August 4 admitted all the 12 applicants to bail including Babatunde, Shittu, Oyetunji and Sunday.

    The court had categorised the bail granted to the applicants into two:

    Eight of the detainees were admitted to bail in the sum of N5m, two sureties each resident in Abuja, with evidence of two years’ tax payment.

    The remaining four – whose bail the DSS opposed – had their bail terms in the sum of N10m, two sureties each resident in Abuja with one of them being a civil servant in a Federal Government ministry or any of its agencies with grade-level not less than 12.

    The 24 sureties had been secured last week but the presiding judge who was to sign their Release Order was said to have travelled abroad.

    But Justice Egwuatu on Monday signed the Release Order of the contested four who had their complete eight sureties. He is also expected to sign the Release Order of the remaining eight once their 16 sureties were completed.

    All the detainees were arrested around 1am on July 1, 2021, when the DSS “raided” Igboho’s Ibadan residence in a Gestapo style.

    The secret police also said its operatives killed two other associates of the activist in a “gun duel.”

    The 12 detainees had approached the court to seek their release.

    Igboho, wanted by the DSS, has been in detention in Cotonou, Benin Republic, since July 19, 2021 when he was arrested at an airport as he tried to board a Germany-bound flight.

    DSS Obeys Court Order, Produce All Igboho’s Aides in Court

    The Department of State Service (DSS) on Wednesday produced all 12 detained aides of Sunday Adeyemo popularly known as Sunday Igboho before the Federal High Court in Abuja.

    This comes less than seventy-two hours after the court ordered the agency to produce all aides of the Yoruba Nation agitator.

    On Monday the DSS produced only eight of the detained aides at the court.

    The aides were arrested when DSS officials raided Igboho’s home on July 1, but a lawyer to the apprehended aides, Pelumi Olajengbesi, has sued on grounds that their fundamental human rights were being infringed on.

    The DSS had paraded the aides and accused them of stockpiling arms to cause chaos in the country.

    After the DSS raid on his (Igboho) home, he fled to the Benin Republic and is presently in court fighting extradition back to Nigeria.

    The Department of State Services (DSS) on Monday produced before a Federal High Court in Abuja eight out of the 12 detained associates of the advocate for Yourba nation, Sunday Adeyemo aka Sunday Igboho.

    They were arrested during a July 1 raid on Igboho’s Ibandan (Oyo State) residence by operatives of the DSS.
    DSS’ lawyer, I. Awo said the production of the detainees was in compliance with an earlier order by the court.

    Lawyer to the detainees, Pelumi Olajengbesi, queried the decision by the DSS to hold on to the other four.

    The actual identity of the eight brought to court was imminently established.

    We have only three Igboho’s aide with us not 12 – DSS

    The Department of State Services (DSS) has told a court that only three associates of Yoruba nation advocate Sunday Igboho are in its custody. This is contrary to 12 people named in a suit before a Federal High Court in Abuja by some lawyers including Pelumi Olajengbesi and Allen Sowore, after the raid of Igboho’s Ibadan (Oyo State) residence on July 1.

    The gave the names of those being detained as: The detainees Abdullateef Ofeyagbe, Amuda Babatunde (alias Lady K), Tajudeen Erinoyen Diekola Ademola, Abideen Shittu, Jamiu Noah, Ayobami Donald, Adelabe Usman, Oluwapelumi Kunle, Raji Kazeem, Taiwo Opeyemi and Bamidele Sunday.

    The court, on July 23 granted an ex-parte application by the applicants and, among others, ordered the DSS to produce them on July 29 and to show cause why they should not be granted bail.

    At the resumed hearing in the case yesterday, the DSS failed to produce the applicants.

    DSS’ lawyer, I. Awo, apologised for his client’s inability to produce the applicants in court, arguing that they were being detained based on an order from another court pending the conclusion of investigation.

    Awo said the order got for their detention would lapse on August 2 (Monday) and prayed the court to allow the DSS time to conclude its investigation after which it would decide on whether to release or charge them to court.

    The lawyer noted that as against the applicants’ claim, the DSS has three – Amoda Babatunde (aka Lady K), Diokola Adeyemo Admola and Bamidele Sunday – in its custody.

    Awo added that the DSS also had Abdullateef Ofeyagbe (the first applicant) in its custody until July 27when he was released.

    Lawyer to the applicants, Olajengbesi faulted Awo’s claim and insisted that all his clients were being held by the DSS.

    He also faulted the remand order tendered in court by the DSS’ lawyer saying it was not certified.

    Olajengbesi however sought time to enable him respond to the affidavit filed by the DSS in relation to the court’s order for it to show cause.

    Ruling, Justice Obiora Egwuatu restated the order for the applicants’ production on the next adjourned date.

    Justice Egwuatu also ordered the DSS to allow the applicants’ lawyers access to them between today and Monday.

    He adjourned till Monday for the DSS to produce them in court and for further hearing in the case.

    In its affidavit, the DSS said its July 1 raid on Igboho’s residence was a joint operation by its operatives and men of the Nigerian Army.

    It stated that the raid was informed by suspicion that Igboho and his associates were involved in criminal activities.

    The DSS added that its operatives recovered a number of arms and ammunition during the raid, noting that investigation in the case “has assumed a wider dimension and sophistication.”

    It stated that “the activities of the applicants in custody constitute threat to national security of Nigeria.

    “Any attempt to grant the applicants ball at this stage of investigation, may jeopardise on-going investigation in the matter.

    “The respondents will not hesitate to formally charge the applicants to court or bring them before the court at the conclusion of investigation.”

    JUST IN: DSS Fails To Produce Igboho’s Detained Aides In Court

    The Department of State Services (DSS) has defied a court order to produce the 12 detained aides of Yoruba-nation agitator, Sunday Adeyemo,  popularly known as Sunday Igboho.

    Justice Obiora Egwuatu of the Federal High Court in Abuja had ordered the DSS to produce in court on July 29, the 12 aides who have been in their custody since July 2, 2021.

    Their case was expected to proceed regardless of the annual court vacation slated to begin on July 26.

    But since the DSS failed to bring the aides before the court on Thursday, Justice Egwatu has now issued another order, asking the DSS to produce the 12 Aides of Sunday Igboho in court on Monday, August 2.

    While giving the order, he stressed that when a court of competent Jurisdiction, gives an order, such must be respected and obeyed.

    Justice Egwatu also made an order directing the DSS to make way for the Counsel to the 12 Aides to see them between today and the next adjourned date (Monday).

    The suspects had earlier sued the DSS before the Federal High Court Abuja, on grounds that their fundamental human rights had been infringed.

    BREAKING: Court orders DSS to produce detained Igboho’s aides in court

    A Federal High Court, Abuja, on Friday, ordered the Department of State Services (DSS) to produce the 12 detained associates of Yoruba nation activist, Sunday Adeyemo, aka Sunday Igboho, before it on July 29. 

    Justice Obiora Egwuatu gave the order after Counsel to the applicants, Pelumi Olajengbesi, moved the ex-parte motion marked: FHC/ABJ/CS/647/2021 dated July 7 and filed July 8. Egwuatu also ordered the Nigeria’s secret police to come and show course why the applicants should not be granted bail. 

    The judge also granted the plea of the applicant, through the affidavit of urgency filed, on why the matter should be heard expeditiously irrespective of the imminent court vacation. 

    Daybreak recalls that at least a dozen of Igboho’s associates were arrested and detained by the DSS on July 1 after a raid on Igboho’s residence in the Soka area of Ibadan, the Oyo State capital.

    The DSS also said that it “gunned down” two of the activist’s associates during a “gun duel” which Igboho narrowly escaped.

    He was later declared wanted for allegedly stockpiling arms, an allegation he denied.
