Nine Southern Kaduna natives, led by Adara elders, have filed a lawsuit against former Kaduna State Governor, Malam Nasir El-Rufai, over alleged violations of their fundamental human rights. The plaintiffs, including the former Chairman of the Adara Development Association, Mr. Dio Maisamari, are seeking N2.3 billion in damages for arbitrary arrest, imprisonment, and general exemplary damages.
The case, heard at the Federal High Court in Kaduna on Tuesday, was adjourned by Justice Hauwa’u to allow for proper service of the court summons to the respondents, as required by **Order 5 Rule 7** of the Fundamental Human Rights Act.
Speaking to reporters after the adjournment, counsel to the plaintiffs, Barrister Gloria Ballason, explained that her clients were wrongfully imprisoned for over three months in 2019 by the immediate past administration, only to be released when no charges were found against them.
“We are here for a case of unjust imprisonment of the Adara elders, who were detained in 2019. They have come to court to seek the enforcement of their fundamental rights,” Ballason stated.
She also noted that the wrongful arrest occurred around the time of the killing of Chief Rafael Maiwada Galadima, under questionable circumstances. The plaintiffs allege that Mr. Dio Maisamari, along with eight others, was detained without investigation or reasonable suspicion.
“The administration of Mallam Nasir El-Rufai was notorious for rights violations, including wrongful imprisonments and killings,” said Ballason. She further added that the plaintiffs are seeking N900 million in compensation for arbitrary arrest, N100 million for general and exemplary damages, and N500 million for other damages. Additionally, they are requesting N800 million for special damages, citing the significant rights violations they suffered.
The case was adjourned for further proceedings after the completion of the necessary legal processes.
