Zenith Bank MD risks jail over contempt of Court

A high court sitting in Kaduna has granted a motion seeking the Managing Director (MD) Zenith Bank Plc Ebenezer Onyeagwu to obey court order or be send to prison for contempt of court.

“Take notice that unless you obey the directions contained in this order, you will be guilty of contempt of court and will be liable to be committed to prison”, the order stated.

The high court in Kaduna in the Suit N0.KDH/KAD/888/2021, between Jecinta Uloma Ibe (plaintiff) and three others,
had granted approval for an order seeking imprisonment of the Zenith Bank MD for disobeying court order to pay the sum of N14, 216,107 34k withdrawn from Zenith Bank Account no 1003005241 belonging to Mrs. Florence Ngozi Aguwa.

The Court held that the 3rd defendant/applicant in the case Mr. Nnaemeka Magnus Aguwa, applied to “this Court for an order for your committal to prison for having disobeyed the Order of this Court made on the 5th day of October, 2021.
“For having neglected to obey the order made on the 5th day of October, 2021, requiring you: to pay the sum of N14, 216,107 34k (Fourteen Million, Two Hundred and sixteen Thousand Naira, Thirty Four Kobo only) withdrawn from Account no 1003005241 belonging to Mrs. Florence Ngozi Aguwa and domiciled with the 1st Defendant/Respondent into Account No.0230780257 belonging to Mrs. Florence Ngozi Aguwa domiciled with Guaranty Trust Bank Nigeria PLC pending the determination of the Motion on Notice filed by the 3rd Defendant/Applicant before this Honourable Court.

Earlier in “Form 48, notice of consequences of disobediece to Order of court”, addressed to the Managing Director, Zenith Banks Plc, and signed by the court registrar, court stated that “Take notice that unless you obey the directions contained in this order, you will be guilty of contempt of court and will be liable to be committed to prison.
the statement is titled: “In the high court of justice kaduna of kaduna state of Nigeria in kaduna judicial division Holden at kaduna with SUIT NO.: KDH/KAD/888/2021 between Jecinta Uloma lbe, now Jecinta Uloma Agha Oji plaintiff/respondent and the 3 others: Zenith Bank Plc 1st defendant/respondent, The commissioner of police Fct 2nd defendant/respondent and third defendant/applicant Mr. Nnaemeka Magnus Aguwa respectively…..
The e court held that actions of “the 1st Defendant/Contemnor showed gross disrespect and contempt for this Honourable Court by not obeying and or complying with the Order of this Honourable Court”.

Recalled that Mrs Jecinta Uloma Agha Oji wife of Nigerian army officer reportedly withdraw over N14 from Zenith Bank account of her late sister who was the wife of Mr Nnaemeka Aguwa without the consent of the husband.
