The fourth prosecution witness (PW4) in the trial of former Minister of Power, Olu Agunloye, on Tuesday told the FCT High Court in Apo, Abuja, that the extract of the Federal Executive Council (FEC) minutes presented before the court originated from the Office of the Secretary to the Government of the Federation (OSGF).
The witness, Ugochukwu Christian Okoli, gave the testimony during cross-examination by prosecution counsel, Abba Mohammed, SAN. According to a release by Dele Oyewale, Agunloye is being prosecuted on an amended seven-count charge bordering on alleged official corruption and the fraudulent award of the $6 billion Mambilla Power Project contract to Sunrise Power Transmission Company Limited.
Okoli, who was posted from the Federal Ministry of Justice to the OSGF as an Assistant Legal Adviser, explained that he handled a request from the Economic and Financial Crimes Commission (EFCC) for an extract of the FEC minutes of May 21, 2003. The request related to a memo on the construction of the 3,960-megawatt Mambilla Hydro Electric Power Station.
He told the court that the request was processed through the appropriate channels, including the Legal Department and Cabinet Affairs Office, where the relevant file was retrieved and reviewed. He confirmed that the information was contained in official records and recommended certification of the extract.
According to him, the certified true copy was approved and forwarded to the EFCC with a covering letter. He also identified Exhibits 3C and 3E as the documents processed and dispatched. Justice Jude Onwuegbuzie adjourned the case to April 30, 2026, for further proceedings.
