Outrage, as Kaduna AG stops criminal Case against justice Maikori Son, 2 others

There is outrage in Kaduna State as the Attorney – General and Commissioner for Justice, of the State, Aisha Dikko, has directed that the criminal case between the Commissioner of Police, Yahaya Maikori, son of retired justice Maikori and 2 others be discontinued immediately

The AG, in a letter dated 20th November 2019 and acknowledged by the office of the Chief Magistrate Court No 3 Daura road on 24th January 2020, stated that section 211 (1) (c) of the constitution of the Federal Republic of Nigeria 1999 (as amended) conferred on her, the power to discontinue with the criminal case pending before the Magistrate Court.

The counsel to the complainant, J. A Achimugu had earlier written to the Attorney General, on behalf of his client, Alh. Aminu Aliyu, that the request to terminate the First Information Report, F.I.R, is very strange and a denial of justice to his client from the fountain of justice.

According to the letter addressed to the AG’s office dated 10th December 2019 by J. A Achimugu and Co, it stated that his client ( Alh. Aminu Aliyu), “Who is the victim of the alleged offences in the F.I.R feels very strongly that the request of the AG is very strange and a denial of justice to him from the fountain of justice.

“The desire to terminate the F. I. R in favour of Yahaya Maikori and two others is clearly designed to aid and facilitate their pending civil suit against our client before the High Court of Justice, No 8 of Kaduna State where they are alleging malicious complaint by our client against them.

“The Defendants who are to be favoured by the request for the termination of the F. I. R have a civil suit against our client rising from the same F. I. R where they are claiming inter Alia the sum of N15 million against our client and coming up for hearing on 22rd January, 2020.

“When the Hon. Attorney General wanted to have the parties settled this matter through the Office of the then O/C Legal Police Headquarters, Kaduna, our client did not refuse but Yahaya Maikori never showed up for any settlement”.

recalled that sometimes in 2019, Alh Aminu Aliyu had complained to the deputy commissioner of police investigation and intelligent department, alleging that he sold a housing property located at no. 5 keffi road Barnawa  kaduna, to one Anzola Resources ltd, in march 2019 and served the said suspect and Co. with a notice to vacate the property. 

However, it was contained in the FIR that the suspect, while parking out of property vandalized the doors and other valuables items worth N942, 000 were removed which led to litigation.  End
