El-Rufai Sues ICPC for N10bn, Demands Family Access in Detention
By Abigail David
Former Kaduna State Governor Nasir El-Rufai has filed a fresh N10 billion fundamental rights suit against the Independent Corrupt Practices and Other Related Offences Commission over the alleged denial of access to his wife and son while in custody.
The suit, marked FHC/ABJ/CS/1852/2026, was filed at the Federal High Court in Abuja on August 13 by El-Rufai’s lawyer, Ubong Akpan.
The ICPC chairman and the Attorney-General of the Federation were joined as the second and third defendants.
El-Rufai alleged that the commission repeatedly prevented his wife, Aichatou Asabe, and son, Abba El-Rufai, from visiting him, despite their role in providing food, medication and other necessities.
He further alleged that ICPC officers physically restrained and intimidated his wife and son on July 7.
The former governor argued that the alleged restrictions violated his fundamental rights to dignity and privacy under the 1999 Constitution and the African Charter on Human and Peoples’ Rights.
Among the reliefs sought, El-Rufai is asking the court to declare the alleged denial of family access unconstitutional and order the ICPC to grant him reasonable and unhindered access to his family and legal counsel throughout his detention.
In an affidavit supporting the suit, El-Rufai’s Principal Secretary, Mohammed Shaba, said Asabe had regularly visited the former governor before July 7 and supplied him with food, clothing, medication and other personal necessities.
Shaba also referenced an earlier order by Justice R.M. Aikawa directing the ICPC to allow detainees access to their lawyers and personal physicians.
The latest case is one of several legal actions El-Rufai has instituted against the ICPC since the commission began investigating him.
In February, he filed a separate N1 billion fundamental rights suit challenging the alleged search of his Abuja residence.
