Appeal Court Overturns Musa Kwankwaso’s (APC) Victory, Confirms Yusuf Datti’s (NNPP) Election

By Milcah Tanimu

The Court of Appeal in Abuja has invalidated the election victory of Musa Ilyasu Kwankwaso from the All Progressives Congress (APC) and has upheld the election of Yusuf Umar Datti from the New Nigeria People’s Party (NNPP) in the Kura/Madobi/Garun Malam Federal Constituency Election.

A three-judge panel, led by Justice Tunde Oyebamiji Awotoye, accepted an appeal filed by Yusuf Datti. They ruled that the tribunal had erred in counting the date of the appellant’s resignation on the day of his party’s primary election and had misapplied Section 77 of the Electoral Act. The court also emphasized that no court had jurisdiction over matters related to party membership.
